Terms and Conditions
Tajlandia ("Tajlandia," "we," "us," or "our")
Last updated: August 27, 2026
1. Acceptance of These Terms
By accessing or using the Tajlandia website and services (the "Service"), including claiming a symbolic location, purchasing a digital certificate, or registering for our priority list, you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and our Risk Disclosure. If you do not agree, do not use the Service.
The Service is operated by Tajlandia Digital Sp. z o.o., registered at ul. Marszałkowska 126/134, 00-008 Warsaw, Poland, registration number KRS 0000999999 (the "Company").
2. Nature of the Service - Read This Carefully
Tajlandia sells a symbolic, novelty digital-keepsake experience. It is not real estate, not a property or land title, not a financial investment, and not cryptocurrency or a crypto/blockchain asset.
When you "claim" a location on our interactive map, you receive a personalized digital certificate that commemorates the claim, including a region/landmark name, coordinates, a certificate number, and issue date, for entertainment, gifting, and personal-keepsake purposes only.
Claiming a location:
- Does not transfer, create, or evidence any legal right, title, deed, lease, or interest in any real property in Thailand or anywhere else.
- Does not grant any right to occupy, visit, develop, sell, or use the physical land referenced.
- Does not constitute a financial product, security, investment contract, or deposit, and carries no expectation of profit, appreciation, resale value, or return.
- Does not constitute cryptocurrency, an NFT, or any blockchain-recorded asset, unless expressly stated otherwise on the specific product page at the time of your purchase.
Please also read our full Risk Disclosure, which is incorporated into these Terms by reference.
3. Eligibility
You must be at least 18 years old (or the age of legal majority in your home jurisdiction) and have the legal capacity to enter a binding contract to use the Service. By using the Service, you confirm you meet these requirements. If you are purchasing as a gift for a minor, you (the purchaser) are the contracting party and remain responsible for compliance with these Terms.
4. Orders, Pricing, and Payment
- Prices are displayed at checkout, starting from $1 per symbolic claim, plus any applicable taxes, currency-conversion fees, and payment-processor fees.
- All payments are processed through third-party payment processors. We do not store your full card details.
- Prices may be shown in multiple currencies for convenience; the currency and amount actually charged will be confirmed at checkout.
- We reserve the right to correct pricing errors before an order is confirmed, and to refuse or cancel an order affected by an obvious pricing or system error, with a full refund of any amount charged.
- A digital certificate is issued only after successful payment confirmation.
5. Digital Certificates and Delivery
- Digital certificates are delivered electronically (by download and/or email) to the email address you provide.
- You are responsible for providing an accurate email address and for downloading/saving your certificate; we are not responsible for certificates that are undeliverable due to an incorrect address or full inbox.
- Each claimed location/coordinate combination is intended to be issued to one certificate holder, but our map/claim system is a game-like, entertainment feature. The same real-world coordinates are not exclusively or legally "owned," and we do not guarantee uniqueness against future products, promotions, or map resets, except as stated on the relevant product page.
- We may, at our discretion, offer certificate customization, re-issuance, or replacement (for example, for a corrected name) subject to any fee shown at the time.
6. Gifting
If you purchase a certificate as a gift, you are responsible for the accuracy of the recipient's details and for any message you include. We are not responsible for the recipient's reaction to or use of a gifted certificate. Gifted certificates are subject to these Terms as if the recipient were the original purchaser for use purposes, but the purchaser remains the contracting/paying party.
7. Right of Withdrawal / Cancellation (Poland / EU Consumers)
If you are a consumer located in Poland or another EU/EEA member state, you generally have the right to withdraw from a distance contract within 14 days without giving a reason, under the Polish Act of 30 May 2014 on Consumer Rights (implementing EU Directive 2011/83/EU).
However, because our digital certificate is supplied to you immediately in digital form (not on a tangible medium):
- At checkout, we will ask you to expressly consent to immediate delivery/performance and to acknowledge that, by doing so, you lose your right of withdrawal once delivery of the digital certificate begins, in accordance with Article 38(13) of the Polish Consumer Rights Act (mirroring Article 16(m) of Directive 2011/83/EU).
- If you do not give this consent, we will not begin delivering your digital certificate until the standard withdrawal considerations no longer apply, or we may be unable to fulfil an immediate-delivery order.
- Nothing in this section limits your statutory warranty rights for defective digital content under Polish/EU consumer law (for example, a certificate that fails to be delivered or is materially different from what was ordered due to our error).
For consumers in Thailand: Thai consumer protection law does not impose an equivalent mandatory 14-day cooling-off right for this type of digital content sold online, but we will honor any refund we expressly commit to on a product page or promotion, and any remedy required under the Thai Consumer Protection Act B.E. 2522 (1979) for defective or misdescribed goods/services (for example, a certificate not delivered due to our system error).
For all users: Except as set out above or required by mandatory law, sales of digital certificates are final and non-refundable once delivered, given the instant, personalized nature of the product.
8. Intellectual Property
All content on the Service, including the Tajlandia name and logo, website design, map graphics, certificate templates, and text, is owned by or licensed to the Company and protected by Thai, Polish, EU, and international intellectual property laws. Your certificate is licensed to you for personal, non-commercial use (viewing, printing, gifting, and sharing as a keepsake). You may not reproduce, modify, resell, sublicense, or commercially exploit our content or certificate templates without our prior written consent.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms;
- Attempt to interfere with, hack, or disrupt the Service or its security;
- Use automated means (bots, scrapers) to access the Service without our permission;
- Impersonate another person or provide false information when claiming or gifting a certificate;
- Use the Service to imply, market, or represent that a certificate confers real property rights, investment value, or cryptocurrency status.
We may suspend or terminate access to the Service for any user who breaches this section.
10. Disclaimers
To the maximum extent permitted by applicable Thai and Polish/EU law:
- The Service and all certificates are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
- We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any particular location will remain available to claim.
- We make no representation about the future value, resale potential, or collectability of any certificate.
Nothing in this section excludes or limits liability that cannot lawfully be excluded or limited under Polish/EU or Thai consumer-protection law, including liability for fraud, death, or personal injury caused by our negligence, or statutory consumer guarantees.
11. Limitation of Liability
To the maximum extent permitted by applicable law, the Company's total liability to you arising out of or relating to the Service, whether in contract, tort, or otherwise, shall not exceed the total amount you paid to us in the 12 months preceding the event giving rise to the claim. We shall not be liable for indirect, incidental, consequential, special, or punitive damages, or for loss of profits, goodwill, or data.
This limitation does not apply to liability that cannot be limited under mandatory Polish/EU consumer law or Thai law (including liability for gross negligence, willful misconduct, fraud, or death/personal injury).
12. Indemnification
You agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Service, except to the extent caused by our own breach or negligence.
13. Changes to the Service and These Terms
We may modify, suspend, or discontinue any part of the Service at any time. We may update these Terms from time to time; material changes will be notified via the website or by email, and will take effect for new orders placed after the notice period required by applicable law. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms, without prejudice to your statutory consumer rights.
14. Termination
We may suspend or terminate your access to the Service at any time for breach of these Terms, fraud, or suspected unlawful activity. You may stop using the Service at any time. Sections that by their nature should survive termination (including Sections 2, 8, 10, 11, 12, 15, and 16) will survive.
15. Governing Law and Dispute Resolution
- If you are a consumer resident in Poland or the EU/EEA: these Terms are governed by Polish law and, where mandatory EU consumer-protection provisions of your own country of residence would otherwise apply, those mandatory provisions are not overridden. You may bring proceedings in the competent Polish court or in the courts of your own EU/EEA member state of residence, as applicable law permits. EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform at ec.europa.eu/consumers/odr.
- If you are a consumer resident in Thailand: these Terms are governed by the laws of Thailand, without prejudice to any mandatory consumer protections under the Thai Consumer Protection Act B.E. 2522 (1979), and disputes may be brought before the competent Thai courts, including the Consumer Case Procedure under Thai law.
- For all other users (non-consumers, or users outside Poland/EU/Thailand), these Terms are governed by the laws of Poland, and the parties submit to the exclusive jurisdiction of the courts of Warsaw, Poland, without regard to conflict-of-law principles.
Nothing in this section deprives a consumer of protections they cannot contractually waive under the mandatory law of their country of habitual residence.
16. Miscellaneous
- Entire agreement: These Terms, together with our Privacy Policy and Risk Disclosure, constitute the entire agreement between you and the Company regarding the Service.
- Severability: If any provision is found unenforceable, the remaining provisions remain in full effect.
- No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
- Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your rights without our consent.
- Language: These Terms are provided in English. Where a Polish translation is also published on the website, the English version controls in case of conflict, except where local law requires the local-language version to control for consumers.
