This Risk Disclosure is incorporated by reference into our Terms and Conditions.

1. Purpose of This Disclosure

Before you claim a symbolic location or purchase a digital certificate on Tajlandia, please read this Risk Disclosure in full. It explains, in plain language, what you are and are not getting, and the risks involved. By completing a purchase, you confirm you have read, understood, and accepted this Risk Disclosure.

2. This Is Not Real Estate or a Property Right

  • Tajlandia sells a symbolic, novelty digital keepsake. Claiming a location on our map does not transfer, register, or evidence any legal title, deed, lease, easement, or possessory right over any physical land in Thailand or elsewhere.
  • We are not a licensed real-estate broker, developer, or land agent in Thailand, Poland, or any jurisdiction, and no representation is made that you can visit, occupy, develop, subdivide, or otherwise deal with the referenced physical location as an owner.
  • Ownership of land in Thailand is governed by Thai land law (including strict rules and restrictions on land ownership by foreign nationals). Nothing about your digital certificate changes, satisfies, or interacts with those legal requirements in any way.

3. This Is Not a Financial Investment

  • Your purchase is not a security, investment contract, deposit, fund unit, or financial product under Thai, Polish, or EU law, and Tajlandia is not a regulated financial services provider, broker, or investment adviser in any jurisdiction.
  • There is no expectation, promise, or guarantee of profit, income, appreciation, dividend, interest, or any financial return of any kind.
  • The amount you pay (from $1 upward) should be treated the same as spending money on a novelty gift, souvenir, or entertainment purchase: money you should be fully prepared to lose the value of entirely, with no realistic expectation of resale or recoupment.
  • Do not purchase a certificate as a retirement plan, savings vehicle, speculative asset, or part of any investment portfolio.

4. This Is Not Cryptocurrency or a Blockchain Asset

  • Unless a specific product page expressly and clearly states otherwise at the time of your purchase, your digital certificate is not a cryptocurrency, token, NFT, or any blockchain-recorded or blockchain-transferable asset.
  • It is a digital image/record stored and issued through our own systems, and it has no independent tradability on any crypto exchange or secondary marketplace operated by us.

5. No Resale Value or Secondary Market

  • We do not operate, endorse, or guarantee any secondary market for reselling, trading, or transferring certificates.
  • If you gift, share, or attempt to resell a certificate outside our platform, we make no representation as to its value, authenticity verification by a third party, or transferability, and we accept no responsibility for such transactions.

6. Uniqueness and Map Risk

  • Our interactive map and claiming feature are provided for entertainment purposes. While we design the system so each claimed spot is presented as personalized to you, we do not guarantee absolute, legally enforceable exclusivity of any real-world coordinate against other current or future Tajlandia products, promotions, partner campaigns, or map resets, except where explicitly stated on the relevant product page at time of purchase.
  • Coordinates, landmark names, and regional information displayed are for descriptive/thematic purposes and may be approximate; we do not guarantee survey-grade accuracy.

7. Platform, Delivery, and Continuity Risk

  • Your digital certificate depends on our website, servers, and email delivery working correctly. As with any online service, there is a risk of downtime, technical error, data loss, or delayed/failed delivery.
  • We do not guarantee that the Tajlandia platform, your account, or your digital certificate's online record will be available indefinitely. If we cease operating the Service, your ability to view, re-download, or verify your certificate through our platform may end, although any file already downloaded by you will remain in your possession.
  • We recommend downloading and independently backing up your certificate promptly after issuance.

8. Payment and Currency Risk

  • Payments are processed by third-party payment providers; we are not responsible for their service interruptions, fees, or errors, though we will assist in good faith to resolve payment issues caused by our own systems.
  • If you pay in a currency different from your home currency, currency-conversion rates and fees are set by your bank or card provider, not by us, and can change between the time you view a price and the time your payment is processed.

9. Data and Cybersecurity Risk

  • As with any online service, there is an inherent risk of unauthorized access, hacking, or data breach despite reasonable security measures. See our Privacy Policy for details on how we protect your data and what happens in the event of a breach.

10. Regulatory Risk / No Regulatory Endorsement

  • Tajlandia is not authorized, licensed, endorsed, or supervised by the Thai Securities and Exchange Commission (SEC Thailand), the Bank of Thailand, the Polish Financial Supervision Authority (KNF), the Polish Office of Competition and Consumer Protection (UOKiK), or any equivalent financial or real-estate regulator, because our product is not a regulated financial or real-estate product.
  • Regulatory characterization of novelty/keepsake digital products can vary and evolve. If law in your jurisdiction were to treat a product like ours differently in the future, we will update our practices and disclosures as required, but this does not retroactively change the nature of what you purchased.

11. Consumer Rights Are Not Affected

Nothing in this Risk Disclosure limits or overrides:

  • Your statutory consumer rights under the Polish Act on Consumer Rights, the EU Unfair Contract Terms Directive, or the Thai Consumer Protection Act B.E. 2522 (1979), including rights relating to a certificate that is not delivered, is defective, or is materially different from what was advertised;
  • Your data protection rights under GDPR or the Thai PDPA, described in our Privacy Policy;
  • Any right of withdrawal you may have as described in our Terms and Conditions.

12. Your Acknowledgment

By claiming a location or purchasing a certificate, you confirm that:

  1. You understand Tajlandia is a symbolic, novelty, gift/keepsake product - not real estate, not an investment, and not cryptocurrency.
  2. You are purchasing for personal enjoyment, gifting, or entertainment, not for financial gain.
  3. You accept that the amount paid may have no resale or recoverable value.
  4. You have read and understood this Risk Disclosure, our Terms and Conditions, and our Privacy Policy.
